Stare decisis.
Abortion wasn't mentioned in the original Constitution. Neither were women. And America enslaved human beings.
All my art can be found on Instagram @fklonskyart.
It has been a few days since I’ve posted anything.
Historic days for sure.
But, my daughters were visiting from out of town.
Neither has known a time when a such a fundamental right of women, the right of reproductive choice, was made illegal as the Court is about to do.
Appropriately, we paid a visit to the graves of revolutionary women Emma Goldman and Elizabeth Gurley Flynn, known as The Rebel Girl. Both are buried along with other revolutionaries in a cemetery in the western suburbs.
“Red” Emma once said, “Women need not always keep their mouths shut and their wombs open.”
Then Tuesday I got my second booster for Covid which knocked me out for the past 36 hours.
I was not in the writing mood.
But nobody who reads me doubts what I think of the Supreme Court’s abortion decision.
I am in contempt of court.
Saturday in Chicago thousands will gather at the Federal Plaza in protest.
I will be joining them, of course.
Thanks to progressive women legislators in Illinois, our state is a safe abortion state. Anticipating that the days of Roe might be numbered, the legislature passed and the Governor signed a bill that will be triggered by the Court’s decision overturning Roe and ensure reproductive rights in Illinois.
Another bill was passed that no longer requires parental notification by teenage females to end a pregnancy.
Then thousands are expected to come to Illinois for abortion procedures from neighboring states where ending an unwanted pregnancy will become illegal.
In Illinois we will need to provide those services and we will.
Chicago has a proud history of defying anti-abortion laws.
Street protest, civil disobedience, electing pro-women candidates.
Whatever it takes.
Thanks to Rich Miller of Capitolfax for posting the Twitter thread of Bloomberg reporter Gregory Korte.
Korte points our that when the Court was deciding the Janus case, it was really setting the stage for overturning Roe.
First they came for the unions.
In Janus, you remember, the Court took away the right of unions to union shops, to represent workers in the public sector.
Justice Kagan wrote in her dissent.
Kagan’s argument could just as well be said about Alito’s Roe argument.
And she likely knew what was coming.
Alito writes that abortion rights were not mentioned in the original Constitution.
Neither were women.
And America enslaved people.
Stare decisis.
